Abstract

The social interaction in human society is a multifaceted web of individuals who express themselves from diverse backgrounds, beliefs, and occupations. The necessity of freedom of speech and disagreement is unquestionable, along with diversity. Despite this, conflicts can occasionally become altercations, resulting in disputes between groups and individuals. Humans choose dialogue or confrontation as the two most effective ways to resolve such disputes. Despite not being used immediately, dialogue is commonly associated with conflict resolution in Indian culture, and it ultimately plays a role in the outcome of the dispute. Modern business is a dynamic and fast-paced world that sees disputes as an inevitable consequence. The resolution of business and corporate conflicts is traditionally referred to as litigation. The disadvantages of alternative dispute resolution (ADR) have increased due to their lengthy nature, high expenses, and burdensome court procedures. However, they remain prevalent. Arbitration and mediation's flexibility, privacy, and efficiency have become more popular. Their appeal lies in their ability to attract companies that prefer less aggressive, faster-paced, and more economical dispute resolution methods. The. Just to let you know, mediation may be used to facilitate communication between parties and an unaffiliated third party. This dispute resolution form has been used since ancient times as a substitute for formal legal proceedings. Mediation's effectiveness in resolving civil, business, administrative, and some insolvency issues extends beyond family and marriage matters. India's ratification of the Singapore Convention in 2023 led to establishing the Mediation Act, 2022—a forward-thinking measure to promote peaceful resolution among parties. Despite its progressive nature, the Act has flaws. This article delves into the key elements of 2023. Perform, comparing it to the 2021 Bill.
