Terms and Conditions for The Law Brigade Publisher (India)

These Terms and Conditions ("Terms") govern your access to and use of the website thelawbrigade.com and any related services provided by The Law Brigade Publisher (India), a Legal Research Division of Libertatem Media Private Limited ("we," "us," "our," or "the Company"). By accessing or using our website and services, including registering an account, submitting manuscripts, or reading content, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
- Scope of Services We operate open access peer-reviewed journals focused on legal research and related fields. Our services are limited to manuscript submission, peer review, editing, formatting, publication, hosting, and archiving of scholarly articles. We do not offer conferences, webinars, custom research, consulting, or any other services beyond journal publications. While we may occasionally partner with conference organizers, such partnerships are outside the scope of our direct services and carry no obligations or guarantees from us. We provide no guarantees for outcomes beyond our direct control, including but not limited to:
- Inclusion or indexing in external databases (e.g., Scopus, Web of Science, UGC-CARE, or similar).
- Achievement of specific citation metrics, journal impact factors, or any other performance indicators.
- Third-party endorsements, recognitions, rankings, or visibility in search engines beyond our own platform. These elements depend entirely on independent third-party decisions and are not part of our services.
- User Registration and Obligations Registration is required for all actions on our website, including submitting manuscripts, accessing full articles, or engaging with content. You agree to provide accurate information during registration and to keep it updated. All users must comply with our Submission Guidelines, which include requirements for formatting, originality pledges, disclosure of conflicts of interest, and ethical standards. By submitting content, you warrant that your work is original, unpublished elsewhere, and does not infringe any third-party rights. You agree not to misuse our website, including unauthorized access, data scraping, submitting false information, or any activity that disrupts our services.
- Article Processing Charge (APC) To sustain our open access model, we charge an Article Processing Charge (APC) only upon formal acceptance of a manuscript for publication. The APC covers:
- Rigorous peer review by expert external reviewers.
- Editorial work, including copyediting and formatting.
- Administrative support for manuscript handling.
- Registration of Crossref DOIs and reference linking.
- Plagiarism checks using Turnitin’s iThenticate to ensure scholarly integrity.
- Technical infrastructure for hosting, maintaining the website, and ensuring global accessibility. This fee enables immediate open access without subscription barriers. No additional charges apply for elements outside our control (as detailed in Section 1). The APC amount will be communicated clearly during the acceptance process.
- Intellectual Property and Licensing Authors retain full copyright in their published articles. All published articles are licensed under the Creative Commons Attribution-NonCommercial-ShareAlike 4.0 International License (CC BY-NC-SA 4.0). Full license details are available at: https://creativecommons.org/licenses/by-nc-sa/4.0/. The copyright and license terms displayed on the individual article page take precedence over any other license terms mentioned in the article's full-text PDF or associated materials. By submitting and publishing with us, you grant us a non-exclusive, royalty-free, worldwide license to publish, distribute, archive, and make the article available under the specified Creative Commons license.
- Disclaimers and Limitations of Liability Our services are provided "as is" without any warranties, express or implied. We do not guarantee:
- Acceptance of any submitted manuscript for publication.
- That peer review will detect all errors, inaccuracies, plagiarism, ethical issues, or methodological flaws in published content.
- Timeliness of publication, as delays may occur due to revisions, reviewer availability, or other factors.
- Accuracy, completeness, or fitness for any particular purpose of published content.
- Uninterrupted access to our website or services. We are not liable for any errors, omissions, or issues in published articles, nor for any consequences arising from reliance on such content. Our total liability in any matter is limited to the amount of the APC paid for the relevant article. We shall not be responsible for indirect, consequential, incidental, or punitive damages. Personal data is handled strictly in accordance with our Privacy Policy. While we implement security measures, we cannot guarantee absolute protection against data breaches or leaks, and we accept no liability for such events.
- Violations and Remedies In cases of detected plagiarism, ethical violations, or discrepancies (before or after acceptance/payment of APC), we reserve the right to request revisions. Failure to comply with revision requests may result in rejection (pre-acceptance) or withdrawal/retraction (post-acceptance). Post-payment scenarios involving unresolved issues do not entitle the author to any refund (see Cancellation/Refund Policy).
- Dispute Resolution and Governing Law
- Internal Dispute Resolution: Any issues or grievances must first be raised with our management via email at [email protected]. You agree not to involve any external entity or authority until we have responded or a reasonable attempt at internal resolution has failed.
- Arbitration: Any controversy or claim arising out of or relating to these Terms shall be settled by arbitration administered by the Gujarat High Court Arbitration Centre (GHAC) in accordance with its rules and the Arbitration and Conciliation Act, 1996.
- Jurisdiction: These Terms are governed by the laws of India. Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
- Changes to Terms We may update these Terms periodically. Changes will be posted on our website with the revised effective date. Continued use of our services after changes constitutes acceptance of the updated Terms.
